Welcome to Lingofrica. By downloading, installing, or using the Lingofrica app or any related services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). All content within the Service — including but not limited to lesson content, audio recordings, text, graphics, logos, icons, images, and software — is the property of Lingofrica Ventures Ltd or its content licensors and is protected by applicable copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for your personal, non-commercial educational use. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Service without our prior written consent.

4. User-Generated Content

If the Service allows you to submit, post, or share content (such as feedback or community contributions), you grant Lingofrica a non-exclusive, royalty-free, worldwide licence to use, reproduce, modify, and display such content in connection with operating and improving the Service. You represent that you own or have the necessary rights to any content you submit, and that your content does not infringe the rights of any third party. We reserve the right to remove any content that violates these Terms or that we find objectionable, at our sole discretion.

5. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We make no guarantees about the accuracy or completeness of the language learning content, though we strive to keep it accurate and up to date.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Lingofrica Ventures Ltd and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or goodwill, arising out of or in connection with your use of or inability to use the Service. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us (if any) in the twelve months preceding the claim.

7. Account Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may also delete your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease, and we may delete your account data in accordance with our Privacy Policy.

8. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Nairobi, Kenya.

9. Changes to Terms

We may revise these Terms at any time by updating this page. The revised Terms will take effect when posted. We will make reasonable efforts to notify users of material changes, such as through an in-app notification or email. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites.
